Data protection information for our social media presences

Thank you for your interest in our social media presence. The protection of your privacy when processing personal data and the security of all business data is an important concern for us, which we take into account in our business processes. According to judgment C-210/16 of the EuGH, the operator of a fan page hosted on Facebook is jointly responsible with Facebook for the processing of personal data collected when visiting the Facebook fan page in terms of data protection law. As it cannot be ruled out that the reasoning of the judgment may also apply to other social media presences, we will provide you with general information below on how we handle your data when you visit our social media presences.

Information pursuant to Art. 4 para. 7 EU General Data Protection Regulation (DSGVO) about us as the controller:

You can reach our data protection officer at [felix.juelch_at_juelch-gmbh.de] or at our postal address with the addition "The Data Protection Officer".

Social networks generally analyze your user behavior comprehensively when you visit their website or a website with specific plug-ins (e.g. like buttons or advertising banners of the respective social network). Since our social media presences are also hosted on the websites of the respective social networks, numerous data protection-relevant processing operations are triggered when you visit them.

If you have your own user account on a social network and are logged into your account when you visit our presence on this social network, all data collected will be directly assigned to your existing account. We therefore recommend that you log out regularly after using a social network. However, your personal data may also be collected under certain circumstances if you are not logged in or do not have an account with the respective social network. In this case, this data is collected, for example, via cookies that are stored on your device or by recording your IP address.

The social networks store the data collected about you as usage profiles and can use these for the purposes of advertising, market research and/or the needs-based design of their website. Such an evaluation is carried out in particular (even for users who are not logged in) to display needs-based advertising and to inform other users of the social network about your activities. If you have an account with the respective social network, the interest-based advertising can be displayed on all devices on which you are or were logged in. You have the right to object to the creation of these user profiles, whereby you must contact the operator of the respective social network to exercise this right. We also recommend that you use the setting options to protect your privacy that the social networks make available to you in various forms in your respective user account.

We have very limited or no influence on the data collected about you by the social networks when you visit our social media presences and the data processing operations carried out by them. Likewise, we are not aware of the full extent of data collection, the purposes of processing or the storage periods. Details on this can be found in the terms of use and data protection provisions of the respective social networks.

§ 1 Your rights

(1) In the following, we will inform you about your rights as a data subject in accordance with Art. 15 DSGVO. You can exercise these rights at any time and therefore contact the relevant controller for the respective data processing directly. Please note that despite the joint responsibility with the operators of the social networks, we do not have full influence on the data processing operations of the social networks. Our options are largely determined by the corporate policy of the respective provider.

(2) Right to information You have the right to request information from us at any time as to whether and which of your personal data is being processed. This also includes information on the purposes of processing, any recipients to whom your data is disclosed, the planned storage period and, if applicable, information on the origin of this data if we have not collected it from you. In addition, you have the right to a copy of your stored personal data.

(3) Right to rectification You have the right to request the rectification of inaccurate personal data stored about you. This also includes the right to have incomplete personal data completed.

(4) Right to erasure You have the right to request the erasure of data stored about you. If data has been published by you, this also includes the obligation to forward all links to this data as well as copies or replications of this data to other controllers responsible for processing this published personal data within the framework of the "right to be forgotten" in accordance with Art. 17 para. 2 DSGVO, taking into account available technology and implementation costs.

(5) Right to restriction of processing You have the right to request the restriction of the processing of data stored about you. This data can then only be processed with your consent or for a limited number of legally defined purposes.

(6) Right to object to processing Insofar as the processing of your personal data is based on the balancing of interests, you can object to the processing. This is the case if, in particular, the processing is not necessary for the performance of a contract with you. When exercising such an objection, you may be asked to explain the reasons why your personal data should not be processed.

(7) Right to withdraw consent under data protection law If you have given your consent to the processing of your data, you can withdraw it at any time. Such a revocation affects the permissibility of the processing of your personal data after you have given it to the controller.

(8) Right to data portability You have the right to receive from the controller the personal data concerning you, which you have provided to the controller, in a structured, commonly used and machine-readable format for the purpose of transmission to another controller. At your request and taking into account the available technical possibilities, this also includes the direct transfer from one controller to another.

(9) Right to lodge a complaint with a supervisory authority You have the right to lodge a complaint with a data protection supervisory authority about the processing of your personal data at any time. You can assert this right with a supervisory authority in the member state of your place of residence, your place of work or the place of the alleged infringement.

§ 2 Processing of personal data by Jülch GmbH

(1) We operate our social media presences in order to draw attention to our services and products and to get in touch with you as a visitor and user of our social media presences and to provide you with information that we consider useful.

(2) As the operator of the social media sites, we have no interest in the collection and further processing of your individual data for personal analysis or marketing purposes. We therefore do not collect any further personal data ourselves beyond the data collection carried out by the operator of the respective social network, unless you contact us on the respective social media platform and transmit personal data to us in the process.

(3) We use the analysis data and tools provided to us by the respective social media platforms to analyze visits to and use of our social media presences. This data is made available to us in anonymized form for this purpose, i.e. no personal conclusions can be drawn.

(4) The operation of our social media presences, including the processing of personal and anonymized user data, is carried out in accordance with Art. 6 para. 1 lit. f. DSGVO on the basis of our legitimate interests in a contemporary and supportive information and interaction opportunity for and with our users and visitors as well as the evaluation and control of our social media activities in consideration of the legitimate interests of the visitors to our social media presences.

(5) The data collected directly by us via the respective social media presence will be deleted from our systems as soon as the purpose for its storage no longer applies, you request us to delete it or you revoke your consent to its storage. Stored cookies remain on your end device until their respective storage period expires or until you delete them. Mandatory statutory provisions - in particular retention periods - remain unaffected.

We have no influence on the storage period of your data that is stored by the operators of social networks for their own purposes. For details, please contact the operators of the social networks directly.
